Criminal Tax Matters

Many Federal (and State) white-collar tax prosecutions are started by another federal investigative agency such as the FBI, DEA, ICE and many others.

Most financial crimes also involve tax crimes and the initial federal investigating agency will bring the IRS Criminal Investigation Division (CID) into the case to examine financial records for possible tax charges. Charges could include tax evasion, tax fraud, filing of false tax returns, as well as failure to file returns timely.

Referrals can come from numerous sources both inside and outside the IRS. An IRS Audit can uncover potential criminal matters while conducting a routine examination. The Collection Division may also make referrals when they believe the actions of a taxpayer is an attempt to evade the payment of taxes. Tips to IRS CID  from former business colleagues, spouses, angry ex-employees and others often begin the opening of a formal criminal investigation.

Usually, the last person to know of the criminal investigation is the target of the investigation. To complete the investigation of all potential tax charges, CID will attempt to interview this person for the purported purpose of "hearing their explanation". In reality, IRS CID uses this explanatory interview to cut off any of the persons legal defenses. Often these interviews end up allowing CID to bring an additional charge for giving a false statement to a federal agent.

With a criminal tax matter itself, the procedure is somewhat different. CID has several layers of review within the IRS itself before it refers the case to the Department of Justice (and ultimately the US Attorney's Office). There's often an opportunity to stop an investigation prior to formal criminal charges being filed. The key to any criminal case is always to keep the client from speaking with the criminal investigators and to retain a qualified Criminal Tax Attorney at the earliest indication that there is a criminal tax investigation.
