Understanding Currently Not Collectible Status

When You Cannot Pay Your Taxes - Call (405) 256-2619!

If it is time to pay your taxes and you simply do not have any funds or assets to pay them, it could lead to serious issues. When this happens, a currently not collectible (CNC) status may be your best option.

You may be able to receive a currently not collectible status if the IRS determines that they are unable to collect taxes from you in the following ways:

  • By way of full payment
  • Installment agreement
  • Offer in compromise

The CNC status is not automatic. You must prove that you qualify and request a CNC status. We at The Carver Law Office, PLLC have the knowledge and experience to help you obtain a currently not collectible status to give you the relief you need at this time.

Currently Not Collectible Statute of Limitations

Once your account is declared currently not collectible, the IRS has to stop all collection activities. This includes levies and garnishments. Annually, the IRS will send you a statement that details the amount of tax you still owe (please note that this is not a bill). The 10-year statute of limitations on tax debt collection is still running while you are in this status.

Usually, your account will stay in its CNC status unless your financial situation improves. If this happens, your account will no longer hold its CNC status and the IRS can begin collecting your taxes again.
